1. Acceptance of Terms

You represent and warrant that: (i) you own the User Content or have the right to use and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

6. Mess Service Listings

Messoka provides a platform for mess service providers to list their services and for users to find and book these services. We do not own, operate, or control any of the mess services listed on our platform.

The information provided in the mess service listings is based on information provided by the mess service providers. While we strive to ensure the accuracy of this information, we cannot guarantee its completeness or reliability.

Any transactions or interactions between users and mess service providers are solely between the user and the provider. Messoka is not responsible for any actions or omissions of mess service providers or users.

7. Bookings and Payments

When you make a booking through our platform, you agree to pay all charges associated with that booking. Payment processing services may be provided by third-party payment processors, and you agree to comply with their terms and conditions.

Cancellation and refund policies are set by individual mess service providers and may vary. Please review the specific terms of each booking before confirming.

8. Intellectual Property

The content, organization, graphics, design, compilation, and other matters related to our services are protected by applicable copyrights, trademarks, and other proprietary rights. Copying, redistributing, or reproducing any part of our services is prohibited without our prior written consent.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

IN NO EVENT WILL MESSOKA, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Messoka, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

12. Governing Law

These Terms and your use of our services will be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration Association. The arbitration shall be conducted in Jharkhand, India.

14. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Messoka regarding our services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our services.
